Row over ‘out of control’ grass in Darwen


RESIDENTS have hit out after a patch of grass was allowed to grow out of control.

People living near the land off Jacks Key Drive say it looks a mess and have complained to the town hall.

But Blackburn with Darwen council bosses say they do not know who owns it and refuse to cut it as they are not responsible.

This is despite residents claiming the council has cut the grass in the past.

One resident said: “The council has cut the grass next to the cemetery and at the entrance to the estate since it was built.

“It is really high now and is an area usually used by local children to play football or cricket at this time of year.

“Basically no one has notified the residents and the grass has just been allowed to grow.”

Residents have met coun-cillors in recent weeks, who have asked council officers to look into the issue.

Lib Dem ward member Karimeh Foster, who repres-ents Whitehall area, said: “It is a mess, and as a councillor it is my responsibility to make sure the job is done.

“These people pay council tax, and they have a right to live in a decent environment.

“I am on their side – and it will be sorted.”

Fellow Lib Dem Simon Huggill, lead member for resources, added: “I am in touch with senior officers who are looking at it and we are waiting for them to report back.”

It is believed the land may still be owned by a housing developer who should be responsible for its upkeep, but nothing definite has been decided.

It could also be unadopted, which would also take it out of the town hall’s remit.

Tory Coun Alan Cottam, responsible for regeneration and environment, said: “We may have cut it in the past but ultimately it is the landowner’s responsibility to cut it and maintain it.”

If the land is privately owned, what has it got to do with the council or whether residents pay their council tax? Is there anything stopping a few of the residents getting together and doing it themselves? If it's their children who play there, perhaps they should take some responsibility.

Mayber like that road they did not know they'd recurfaced, they actually do own it and will realise in a few days...But yes I agree with you..why can't the locals cut the grass themselves..

The locals would probably have cut it themselves if they actually knew the council weren't going to do it. I wondered why it had been left to get in such a mess this year.

I thought the council owned it because they've cut it ever since I can remember and obviously everyone else thought the same. If the residents aren't told these things, how are they supposed to know they should be taking responsibility?

Put a wheely bin on there with it's lid up and I am sure someone will soon find out who owns the land!
If it is just a grass length problem then cut it yourself BUT remember the ideal time to start a mower is 8am on a Sunday morning!

If someone cuts it and then someone else's little darling slips on the clippings all hell will break out. The landowner could sue for damage to the grass. Funny old world we've slipped into without noticing!

If the land is not adopted, doea that mean the road is not adopted either? If nor then how can the council create a bus terminus and build a bus stop which they did several years ago without any consultation with residents?
I also wondered why the grass hasn't been cut. The strange thing was that a strip along the edge was cut initially and then halted midway as if someone had been told to stop.There is also a cut strip down to the shed where the council keep their gardening equipment for the cemetery!Hmmm - are they allowed to cut that if it's private property?

We have the same problem with some bushes and trees at the front of our houses!
It was owned by Blackburn with Darwen, then Twin Valley took it over, now it has gone back to Blackburn with Darwen.
We asked them recently if we could have the trees trimmed back as they are well overgrown but nobody seems to know who the piece of land belongs too. My hubby cuts the privets every 2 weeks in the growing season!
Only problem with the Council doing it is that they will come and gut the gardens and leave us with stumps for 3 or 4 years!
Two years ago we got together with our neighbours and spent a weekend clearing and trimming the bushes!
