Blackburn shisha cafe owners admit breaking smoking laws


THE owners of a shisha café have pleaded guilty to allowing the premises to be used for smoking.

The Oceana Café Bar, Darwen Street, Blackburn, fell foul of anti-smoking laws when they were first introduced.

Now two members of a new management team have been prosecuted for allowing the smoking of shisha pipes in upstairs rooms.

Mobin Ugradar, of Johnston Street, Blackburn, and Naeem Ugradar, of Rhyl Avenue, Blackburn, both pleaded guilty to failing to prevent smoking in smoke free premises.

Speaking after the case, a spokesman for the cafe said the upstairs section had been sublet by the owners to a man who had now left.

Mobin Ugradar was fined £120 with £527 costs and Naeem Ugradar was fined £90 with £527 costs.

Carol Curtin, prosecuting for Blackburn with Darwen Borough Council, said that when enforcement officers visited the premises on October 16 there were men and women sitting round shisha pipes.

The following day, when Naeem Ugradar was in charge, enforcement officers found a group of males smoking in a room on the first floor and two groups smoking in rooms up another flight of stairs. The officers decided to leave after a group of males started to become aggressive.

Both defendants pleaded guilty by letter and said they had only been involved with the business for about eight months.

They said they weren’t fully aware of the legislation. Mobin said customers were demanding the service and the business was not doing well and needed all the custom it could generate.

Shisha is a Middle East tradition in which fruit-scented tobacco is burnt, passed through a water vessel and inhaled through a hose.

Hi genesis,

So what is the legal definition of smoking based on. Is it the burning of a substance or the inhalation of any smoke in any public premises.?

"Molasses"Weird things that some people smoke.

It was definatley secnted tobacco that I was given in Istanbul, they went to great lengths to show me how they marinated it.

The water does however takes the tar content out.

Nanny State strikes again, why would anyone go to a shisa cafe if not to smoke, so how can it be doing anyone any harm


On Kens point, it is only tobaco that is banned.
On a recent trip Amsterdam, it was told that the coffe houses can now only allow people to smoke canabis without blended tobac.
I bet the dutch are more cross-eyed than normal

What can I say? In the thousands of examples you see on TV where any groups of males become aggressive, they always get arrested - Section 5 I believe. I wonder why the po-po left on this occassion? "Sarge, the occupants are getting aggressive."
"Get the hell out of there. Retreat. Retreat".
Landlords - ask your patrons to become aggressive against the police and it appears that they will leave and allow the smoking to continue.

Is the upstairs rooms part of the licenced premises or are they for friends and families only?

As a non smoker i find it very hard to believe how this law has been allowed to get through without more of a fight from people!! As for shisha cafes coming under this ban, is beyond belief, as this is their business and should be be exempt as in New York. This labour goverment have certainly ruined and taken away our choices of where we should go and not go. I mean non smokers, as myself would only enter a shisha cafe by choice knowing as i have often with friends here in London. I do not need a nanny state controlling goverment (as labour are/were !dictating to me where i i should go or not. This also applies to pubs and bars who should be allowed to designate a smoking area inside of which is seperate from the bar area and a sign informing customers that smoking is or not allowed,then individuals can choose if to enter or not. This is what democracy is supposed to be about, however under this rancid goverment so many of out freedoms have been destroyed and the sooner they are gone, the better. How many more pubs, cafes etc have to close b4 a new goverment brave enough to do it, ammends this horrendous piece of legislation imposed on us with lies and crass evidence about passive smoking etc. Lastly i am a non smoker whom is very angry and appalled at the way this now ruined goverment has inflicted upon us as a nation more and more laws to curtail our freedoms when the corruption and hypocrisy is now out of the bag making a total mockery of the current goverment and tories etc. Lastly for the record they have exempted their own bar from the smoking ban and of course drink with tax free abandomen!!
