TRAVELLERS living in Hyndburn are set to fight to remain there.

The Jones family have been living at Fir Trees in Sough Lane, Guide, beside a herd of around 40 horses, but their temporary planning permission expired last October, meaning they are no longer allowed to stay there.

An appeal against Hyndburn Council’s decision to refuse permanent permission will be heard next month.

Town planners and development consultants, Philip Brown Associates, acting on behalf of William Jones, said in a statement: “There is clearly an unmet need for gypsy sites in the area.

“The council has failed to identify a sufficient supply of alternative sites.

“The appeal inspector accepted the Jones family is close knit and needs a site where they can live together as a traditional extended family group.

“She also recognised the benefits for the family of being able to live close their not inconsiderable herd of horses.”

Mr Jones and his family moved to the site from Ewood in Blackburn in 2010, without planning permission, which was later granted for a period of three years following an appeal.

His parents are in poor health, with his father in need of regular dialysis, and children on the site go to school in Blackburn, according to documents.

But the council said a permanent development in the green belt was not appropriate, despite several larger developments being in close proximity.

The council is now planning to appoint solicitor Paul Sedgwick to manage the family’s appeal, which is expected to be heard on Tuesday, June 24.

Six residents have voiced their concern at the Jones’ plans to remain on the site, citing traffic issues and worries about the impact on the green belt.

Highways engineers at the county council also objected.

A council document to go before the appeals panel said: “It is not considered that the personal circumstances of the applicant represent ‘very special circumstances’ to outweigh the harm that would be caused to the openness, visual amenities and purposes of the green belt.”

Nobody at Fir Trees was available for comment yesterday.

Forget the family for a moment. Its the land and facilities needed to keep 40 horses that will be the biggest need. Who owns the land where these 40 animals are kept? Is the current owner expected to simply let his\her land be used to keep these animals

If somebody wants to be a traveller then fair play, travel! If you want to settle then move in to a house and pay the same bills as the rest of us!

Just do what our other ethnic friends do plant an onion on the top and say its a place of worship or something. Seems to work for them I think Mr Jones is being discriminated against yet he will probably have more in common with our ethnic friends than he thinks, dump their rubbish everywhere apart from where it should be, leave their feices all over the place, smelly, scruffy, no tolerance of the law etc,

Yes this site is at Duckworth hall very close to another illegal site set up on Moss Lane Stanhill, not Guide as quoted and pictured in the LET.
This is another typical traveler family destroying beautiful green belt land and doing things without planning permission,
They have appealed on more than one occasion and been given notice to leave but are still there the Council have not got the balls to evict these people.
There is large council run traveler camp sites on Charter street Accrington with lots of empty spaces and also Whinney Hill has spaces to.

If I was to do anything without planning permission the council would have flattened it by now no matter what the circumstances
Come on Hyndburn Council do the right thing and get them off I am sick of paying my council tax for you to keep fighting these appeals the money can be spent doing better things for the local area..

The problem really, is that this country is small and overcrowded and many can no longer enjoy the lifestyle they would prefer.
We have a population density greater than that of both China and India - often described as the world's most populous countries - and realistically, there is no room for nomads in the UK these days, anymore than there is room for any more immigrants after the disastrous policies of NuLabour have caused real crises in so many areas.
Anyway, if these people DO want to settle, they are no longer nomads and are part of the " settled " community and so mustn't expect any special privileges as usually afforded to ethnic minorities in these strange days.

I would like to bet that they claim benefits, that they pay no council tax, that their parents that are in "poor health" are being cared for by the tax funded NHS. What happened to trespass laws in this country? When did it become acceptable to just rock up to someone elses property and think "I fancy a bit of that" and be allowed to do so? theres no need for sites anywhere in the UK if they don't like their situation they can leave and go live in Ireland or Romania
