Comedian Russell Brand and girlfriend Jemima Khan have asked the High Court to continue an injunction against a masseuse who alleges they treated her "like a prostitute".

The couple was first granted the order, restraining Hungarian-born Szilvia Berki from harassing them, last month.

Their counsel, Aidan Eardley, told Mrs Justice Carr today that it stemmed from a £500 birthday present massage arranged by Khan for Brand in the privacy of their own house in June.

He said that Berki's claim that she was assaulted by Brand had been investigated by the police who concluded in July that there was no case to answer.

This decision caused an escalation in the activities of Berki, who had already contacted a newspaper and Unicef where Khan is an ambassador.

She now sent emails to a number of MPs and the Prime Minister, s tarted an online petition and made allegations through her Twitter account.

"All this conduct has caused them very significant distress", he told the judge in London.

Berki, who is representing herself, says the proceedings should be thrown out as they are "absurd" and against her rights as a "crime victim" who was acting in the public interest to protect the country's moral and legal standards.

She told the court that she suffered some mental health problems and was scared, shocked and traumatised: "what happened to me had an impact on my mental health".

"I don't need to be treated like a prostitute because I am a massage therapist. I think this was a misunderstanding because they treated me like a prostitute."

Brand and Khan were not in court.

The judge is expected to give her ruling at 2pm tomorrow (September 11).
